Terms of Service

Terms of Service

Effective date: October 2, 2026
Last updated: October 2, 2026

These Terms of Service ("Terms") govern access to and use of the For Encouragement websites, blog, forms, chatbot, online store, digital downloads, and related online services that link to these Terms (collectively, the "Services"). The Services are operated by David Lennon in Texas, United States ("For Encouragement," "we," "us," or "our").

By accessing or using the Services, creating an account, or purchasing or downloading a product, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Accounts

The Services are not intended for children under 13. If you are between 13 and 17, you may use the Services only with the permission and supervision of a parent or legal guardian. You must be at least 18 years old, or the age of legal majority where you live, to make a purchase unless a parent or legal guardian completes the purchase on your behalf.

If you create an account, you are responsible for providing accurate information, protecting your login credentials, and notifying us if you believe your account has been used without authorization.

2. Informational and Encouragement Content

Articles, music, videos, personal-growth resources, chatbot responses, and other content are provided for general informational, creative, inspirational, and encouragement purposes. They are not medical, mental-health, legal, financial, or other professional advice and should not be used as a substitute for advice from a qualified professional.

Do not submit sensitive medical, financial, legal, or confidential information to the Daily Encouragement chatbot. If you are experiencing an emergency or believe you may harm yourself or someone else, contact local emergency services or an appropriate crisis resource immediately.

3. Acceptable Use

You may use the Services only for lawful, personal purposes and in accordance with these Terms. You agree not to:

• Violate applicable law or the rights of another person.

• Copy, scrape, reproduce, distribute, sell, sublicense, or commercially exploit the Services or their content except as expressly permitted.

• Upload or transmit malicious code or attempt to interfere with the security or operation of the Services.

• Attempt to gain unauthorized access to an account, system, or network connected to the Services.

• Use the Services for fraud, deception, harassment, hate speech, unlawful activity, or infringement of intellectual-property rights.

• Misrepresent your identity or your relationship with another person or organization.

4. Intellectual Property

Except for third-party content and services, the text, graphics, logos, original music, audio, videos, downloadable resources, page designs, and other materials made available through the Services are owned by or licensed to For Encouragement and are protected by applicable intellectual-property laws.

You may view and use publicly available website content for personal, noncommercial purposes. You may share links to our public pages, but you may not reproduce or republish substantial portions of the content without prior written permission. No ownership rights are transferred to you.

5. Digital Product License

Unless a product page or separate license states otherwise, purchasing or downloading a digital product gives you a limited, nonexclusive, nontransferable, revocable license to use that product for your personal, noncommercial use. You may not resell, redistribute, share, upload, sublicense, copy for others, or make the product available through another website, marketplace, file-sharing service, or artificial-intelligence training dataset.

If a product includes different or additional license terms, those product-specific terms control for that product.

6. Products Pricing and Payment

Product descriptions and prices are displayed at the time of purchase and may change without notice. We may correct pricing or description errors, limit quantities, or discontinue a product. If an error affects an order already placed, we may cancel the order and issue an appropriate refund.

Payments are processed by Stripe or another identified third-party payment provider. You authorize the payment provider to charge the payment method you select for the total shown at checkout, including applicable taxes or fees. We do not directly store complete payment-card numbers.

7. Digital Delivery

Products are delivered electronically through a download page, customer account, email, or another method stated on the product page. No physical product will be shipped unless a product listing expressly states otherwise. You are responsible for providing a valid email address and maintaining compatible software and equipment.

If you do not receive access or a download does not work, contact [email protected] so we can attempt to correct the problem.

8. Fourteen Day Digital Product Refund Policy

Paid digital products purchased directly from the For Encouragement store are covered by a 14-calendar-day money-back guarantee unless the product page clearly states a different policy before purchase. You may request a refund for any reason within 14 calendar days after the purchase date.

To request a refund, email [email protected] from the email address used for the order and include your name, order number if available, and the product purchased. Approved refunds will be returned to the original payment method. The time required for the refund to appear depends on the payment provider and financial institution.

When a refund is issued, your license to use the refunded product ends. You must stop using the product and delete copies in your possession. Free products do not have a monetary refund value. We may refuse refund requests involving fraud, repeated repurchase-and-refund activity, or other abuse of this policy, to the extent permitted by law. This policy does not limit rights that cannot legally be waived.

9. Third Party Services and Links

The Services may contain links to, integrations with, or embedded content from third parties, including Launch CRM/HighLevel, LeadConnector, Stripe, Pickaxe, SoundCloud, YouTube, and email-delivery providers. Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for their availability, content, security, or practices.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR PRODUCT WILL PRODUCE A PARTICULAR PERSONAL, CREATIVE, FINANCIAL, OR OTHER RESULT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOR ENCOURAGEMENT AND DAVID LENNON WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING FROM OR RELATING TO THE SERVICES. OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PAID PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. THESE LIMITATIONS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless For Encouragement and David Lennon from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Services, your infringement of another person's rights, or your material violation of these Terms.

13. Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary to protect the Services or other users, investigate suspected fraud or unlawful activity, respond to a legal requirement, or address a material violation of these Terms. Provisions that by their nature should survive termination, including intellectual-property, license, disclaimer, liability, and governing-law provisions, will continue to apply.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal proceeding arising from these Terms or the Services must be brought in a state or federal court with jurisdiction in Texas, except where applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted with a new "Last updated" date. Changes apply prospectively from the effective date stated in the revised Terms. Your continued use of the Services after that date constitutes acceptance of the revised Terms.

16. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. These Terms, together with the Privacy Policy and any product-specific terms presented before purchase, constitute the agreement between you and us concerning the Services.
